Supplemental Terms

These KIM AI Terms supplement the KAST Terms of Service and apply when you use KIM. If these KIM AI Terms conflict with the KAST Terms of Service or any product terms, the KAST Terms of Service or product terms prevail, except where these KIM AI Terms expressly say otherwise.
1. About KIM
KIM is an artificial intelligence system. When you use KIM, you are interacting with an AI system, not a human. KIM operates using generative AI. KIM may help you access support information, understand KAST products and features, retrieve certain account information, prepare or submit certain in-app actions, and connect you with a human support agent where appropriate.
KAST will clearly inform you that KIM is an AI system when you begin interacting with it and will provide information in a clear, distinguishable and accessible way. KAST may also display an AI label during the conversation. If your conversation is transferred to a human support agent, KAST will tell you when the human agent joins and if you are subsequently returned to KIMKIM is an automated tool. KIM is not a human representative, adviser, broker, investment adviser, tax adviser, legal adviser, or fiduciary. KIM’s responses are generated using automated systems and may be inaccurate, incomplete, delayed, unavailable, or not suitable for your circumstances.
2. No advice or personal recommendation
Unless KAST expressly tells you otherwise in writing, KIM provides general information and operational assistance only. KIM does not provide financial advice, investment advice, legal advice, tax advice, accounting advice, credit advice, or any personal recommendation.
You should not rely on KIM as the sole basis for making a financial decision, including whether to buy, sell, hold, transfer, deposit, withdraw, subscribe to, redeem from, or otherwise use any financial product, digital asset, reward, yield product, membership plan, or KAST feature.
You are responsible for considering your own objectives, financial situation, risk tolerance, and legal and tax position. If you need advice, you should consult an appropriately qualified independent adviser.
3. AI-generated information may be incorrect
KIM’s responses, and any text, audio or other content KIM generates, are AI-generated. Where required by applicable law, KAST marks or labels that content as AI-generated, including in a machine-readable format. You must not remove, obscure or alter any such marking.
KAST takes reasonable steps to design KIM to provide helpful and safe responses, including using approved knowledge sources, confidence checks, guardrails, and human escalation. However, AI systems can make mistakes.
KAST does not guarantee that KIM’s responses, summaries, classifications, charts, insights, suggestions, translations, transcriptions, or extracted information will be accurate, complete, current, uninterrupted, secure, error-free, or fit for any particular purpose, except to the extent a guarantee is implied by applicable law and cannot be excluded.
Where KIM cites or relies on KAST help content, product terms, or other source material, the underlying official terms, disclosures, and account records prevail over KIM’s response.
4. User responsibility for actions
KIM may retrieve information to help you prepare for certain actions, such as deposit details, statements, or card and account information, or connect you with a human agent. KIM does not execute any action affecting your account, funds or products — including transferring funds, freezing a card, or creating a payment link. You must take those actions yourself in the KAST app.
KIM will not complete a state-changing action unless you confirm it through the required confirmation flow. Before confirming, you must carefully review all details, including the account, product, amount, currency, asset, network, recipient, fees, timing, limits, and warnings displayed to you.
When you confirm an action, you authorise KAST to submit or execute that action using the details shown. You are responsible for any action you confirm, subject to applicable law and KAST’s error-resolution, unauthorised-transaction, complaint, and dispute processes.
5. Digital asset and transfer risks
Digital assets involve significant risk. Values may fluctuate, transactions may be irreversible, networks may be delayed or unavailable, and digital assets may be lost due to incorrect addresses, incorrect networks, unsupported assets, fraud, cyber incidents, smart-contract failures, market events, regulatory action, or other causes.
If KIM displays a crypto deposit address or network information, you are responsible for verifying that the asset, network, and address are correct before making any transfer. Sending digital assets to the wrong address, using the wrong network, or sending unsupported assets may result in permanent loss, and KAST may not be able to recover them.
6. Rewards, Yield, Reserve, Vault, and Gauntlet
Any information KIM provides about rewards, yield, Reserve, Vault, Gauntlet, or similar features is general information only and is not a recommendation that the feature is suitable for you.
Rewards, yield, rates, benefits, eligibility, limits, fees, redemption terms, liquidity, availability, and risk disclosures may vary by market and may change at any time. Returns are not guaranteed unless KAST expressly states otherwise in the applicable product terms. You may lose value or be unable to access funds immediately depending on the product structure and applicable terms.
KAST may restrict, suspend, modify, or withdraw any rewards, yield, or related feature where required for legal, regulatory, risk, market, operational, or product reasons.
7. Privacy, data use, and conversation records
KAST may process information you provide to KIM, account information, transaction information, device or session information, conversation history, AI outputs, feedback, and related metadata to provide KIM, improve support quality, detect fraud or misuse, monitor performance, comply with law, and improve KAST products and services, including by training, testing and evaluating KAST’s AI systems where permitted by applicable law. Where KAST relies on its legitimate interests for that improvement use, you may object to it at any time by contacting privacy@kastcard.xyz, and KAST will stop using your conversations for that purpose unless applicable law permits otherwise.
KAST may use service providers to support KIM, including AI model providers, speech-to-text providers, fraud detection providers, analytics providers, and customer-support platforms. KAST’s AI model providers process your information on KAST’s behalf and are not permitted to use it to train their own AI models. KAST will handle personal data in accordance with its Privacy Notice and applicable data protection laws, including where your personal data is transferred to or processed in another country.
KAST may redact, tokenise, aggregate, or otherwise protect personal data before it is processed by AI systems where appropriate. KAST may retain conversation records, transcripts, feedback, audit logs, and action-confirmation records for support, compliance, security, legal, audit, and product-improvement purposes, subject to applicable retention periods.
8. Human handoff
You can ask to speak to a human support agent at any time by asking KIM. KIM will not prevent or delay you from reaching a human agent to report an unauthorised transaction, error, fraud or complaint.
KIM may offer or initiate a handoff to a human support agent where KIM cannot answer confidently, where your issue requires human review, where safety or fraud concerns arise, or where KAST determines that escalation is appropriate.
If you proceed with a human handoff, KAST may share your conversation, handoff reason, relevant account context, attachments you submit, and related metadata with KAST support teams and support service providers so they can assist you.
9. Prohibited use
You must not use KIM to:
- seek or generate financial, investment, legal, tax, or other regulated advice;
- attempt to bypass KAST’s security, authentication, compliance, sanctions, fraud, or transaction-monitoring controls;
- provide false, misleading, unlawful, harmful, abusive, or fraudulent information;
- upload or transmit malware or unauthorised content;
- share passwords, private keys, seed phrases, full card numbers, or unnecessary sensitive information;
- reverse engineer, scrape, test, attack, manipulate, overload, or interfere with KIM or any KAST system;
- instruct KIM to ignore safety rules, reveal system prompts, or perform unauthorised actions; or
- use KIM for any unlawful, abusive, sanctioned, or prohibited purpose.
10. Refusals, limitations, suspension, and withdrawal
KIM may refuse to answer, limit responses, ask clarifying questions, end a session, require additional authentication, route you to a human agent, or decline to perform an action. If KIM refuses or limits an action based solely on automated processing and that decision has a legal or similarly significant effect on you, you may request an explanation of the decision and a review by a human, as provided by applicable law.
KAST may suspend, limit, change, replace, or withdraw KIM or any KIM feature, with reasonable notice where required by applicable law, including for legal, regulatory, security, fraud, sanctions, risk, operational, model-performance, provider, market-availability, or product reasons. This does not limit KAST’s ability to take immediate action where reasonably necessary to protect users, KAST or third parties, or to comply with law.
KAST may impose usage limits, message limits, token limits, rate limits, feature flags, regional restrictions, eligibility rules, quiet hours, or other controls.
11. Third-party systems
KIM may rely on third-party systems, models, data sources, communication providers, fraud tools, speech-to-text services, customer-support tools, and infrastructure providers. To the extent permitted by applicable law, KAST is not responsible for delays, failures, outages, inaccuracies, or limitations caused by third-party systems that are outside KAST’s reasonable control.
12. Complaints, disputes, and official records
KIM does not replace KAST’s official complaint, dispute, chargeback, error-resolution, unauthorised-transaction, or customer-support processes. If you need to report an unauthorised transaction, fraud, account issue, complaint, or dispute, you must follow the applicable KAST process.
Your official account records, transaction history, statements, product terms, confirmations, and notices prevail over any inconsistent KIM response.
13. Liability
To the maximum extent permitted by applicable law, KAST is not liable for losses arising from your reliance on KIM outputs, your failure to review information before confirming an action, unsupported or incorrect digital-asset transfers, your misuse of KIM, KIM malfunctions, third-party system failures, losses caused by cyberattacks, or events outside KAST’s reasonable control.
Nothing in these terms limits liability that cannot be limited under applicable law, including any rights you may have for unauthorised transactions, fraud, gross negligence, wilful misconduct, statutory consumer protections, or liability for defective products, including software and AI systems, under applicable product liability law.
