May Referral Campaign Terms and Conditions
1. Introduction
These Referral Campaign Terms and Conditions ("Terms") govern participation in the KAST Referral Campaign, May 2026 (the "Campaign") offered by KAST Tech ("KAST", "Company", "we", "us", or "our") through our website and mobile application (the "Platform").
These Terms supplement and incorporate by reference the KAST Terms and Conditions of Service, the Privacy Policy, and the KAST Referral Program Terms and Conditions (the "General Referral Terms"). In the event of any conflict between these Terms and the General Referral Terms, these Terms shall prevail with respect to matters relating to the Campaign. For matters not addressed in these Terms, the General Referral Terms apply.
By participating in the Campaign, you ("Participant", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not participate in the Campaign.
2. Definitions
In these Terms, the following terms have the meanings set out below. Capitalized terms not defined here have the meanings given to them in the General Referral Terms or the KAST Terms of Service.
- "Base Referral" means a referral that satisfies all of the following: (a) the referred user signs up via the Participant's referral link or code, (b) completes KYC, (c) activates their KAST card, and (d) reaches a minimum of USD 100 in total spend.
- "Campaign" means the KAST Referral Campaign running for the month of May 2026, as described in these Terms.
- "Campaign Period" means 12 May 2026, 00:00 UTC to 31 May 2026 (inclusive), unless extended or shortened by the Company in its sole discretion.
- "Campaign-Qualified Referral" means a Base Referral whose referred user reaches at least USD 500 in total spend on the Platform within 14 calendar days of card activation. Campaign-Qualified Referrals are used to determine eligibility for Leaderboard rankings and the Premium Tier Unlock.
- "Leaderboard" means the publicly shared ranking of Participants by number of Campaign-Qualified Referrals during the Campaign Period.
- "Premium Tier Unlock" means the complimentary grant of KAST Premium tier access awarded to eligible Participants under Section 7.
- "Referral Reward" means the reward of up to USD 250 payable per Base Referral under the existing KAST referral program structure, subject to the milestone conditions set out on the Platform.
- "UGC Contest" means the user-generated content competition described in Section 8.
3. Eligibility
To participate in the Campaign, you must:
- Be a registered KAST user with an account in good standing;
- Have successfully completed KAST's identity verification (KYC) process;
- Have activated your KAST card and completed at least one (1) transaction on the Platform prior to the Campaign Period;
- Not be a resident of, or otherwise connected to, any jurisdiction in which KAST has prohibited or restricted access to the Platform or its services;
- Be legally permitted to receive Referral Rewards and any Campaign incentives under applicable law; and
- Comply with these Terms, the General Referral Terms, and all other applicable KAST policies at all times.
You are not eligible to participate if:
- Your KAST account has been suspended or terminated for any reason;
- You are legally or contractually prohibited from receiving rewards or incentives; or
- KAST determines, in its sole discretion, that you have violated any provision of these Terms or the General Referral Terms.
4. Campaign Overview
The Campaign consists of the following pillars, each running concurrently during the Campaign Period:
- Core Referral Rewards: Each Base Referral earns the Participant up to USD 250 in Referral Rewards, subject to the milestone structure published on the Platform.
- Referral Leaderboard: A competition ranking Participants by number of Campaign-Qualified Referrals, with cash prizes for top performers.
- UGC Contest (#KASTCashback / #KASTReferrals): A social media content competition with weekly prizes.
- Premium Tier Unlock ("Refer Your Way to Premium"): A milestone-based path to complimentary KAST Premium membership access.
- Milestone Bonus: An additional USD 100 bonus for every five (5) Campaign-Qualified Referrals (based on USD 500 spend), capped at USD 500 per Participant during the Campaign Period.
5. Referral Rewards
5.1 Base Referral Rewards
For each Base Referral completed during the Campaign Period, the Participant is eligible to receive up to USD 250 in Referral Rewards, paid according to the milestone reward structure published on the Platform.
5.2 Milestone Bonus
For every five (5) Campaign-Qualified Referrals achieved during the Campaign Period, the Participant will receive an additional bonus of USD 100. Each referred user must have reached a minimum of USD 500 in qualifying spend to count toward the Milestone Bonus threshold. This Milestone Bonus is capped at USD 500 per Participant for the duration of the Campaign.
5.3 Payment
Referral Rewards and Milestone Bonuses will be credited in such form, currency, and at such frequency as specified by the Company on the Platform. The Company's tracking records and calculations shall be final and conclusive.
6. Referral Leaderboard
6.1 Ranking
Participants are ranked on the Leaderboard by the total number of Campaign-Qualified Referrals (referred users reaching at least USD 500 in spend within 14 days of card activation) achieved during the Campaign Period.
6.2 Updates and Publication
Leaderboard standings will be updated and published weekly on KAST's official Telegram, Discord, and X (formerly Twitter) channels. The Company may also share Leaderboard standings through other communication channels at its discretion.
6.3 Prizes
Prizes for top-ranked Participants on the Leaderboard will be announced separately by the Company. The Company reserves the right to determine prize amounts, eligibility thresholds, and distribution mechanics at its sole discretion.
6.4 Verification
The Company reserves the right to verify all Campaign-Qualified Referrals before finalizing Leaderboard rankings. The Company's determination of rankings and prize eligibility shall be final and binding.
7. Premium Tier Unlock
7.1 Eligibility
A Participant who achieves a minimum of ten (10) Campaign-Qualified Referrals during the Campaign Period will be awarded complimentary KAST Premium tier access, subject to availability. For the purposes of this Section 7, each referred user must have reached a minimum of USD 500 in qualifying spend (excluding Excluded Transactions under Section 9) to count toward the ten-referral threshold. The Premium Tier Unlock is limited to the first ten (10) Participants who achieve this milestone during the Campaign Period, on a first-come, first-served basis as determined by the Company's records.
7.2 Duration and Benefits
The Premium Tier Unlock grants access to KAST Premium tier benefits (including enhanced cashback rates and exclusive perks as described on the Platform) for a period of six (6) months from the date of activation. The Premium Tier Unlock includes all KAST Premium benefits except for the issuance of a physical metal card.
7.3 Limitations
The Premium Tier Unlock is a one-time award per Participant per Campaign Period, and is limited to a maximum of ten (10) awards across all Participants. It is non-transferable and cannot be exchanged for cash or other benefits. If the Participant's KAST account is suspended or terminated during the Premium access period, Premium tier access will be revoked immediately.
8. UGC Contest
8.1 Participation
Participants and all eligible KAST users may enter the UGC Contest by posting original content (screenshots, videos, or other approved formats) showcasing their KAST referral earnings or cashback rewards on X, Instagram, or TikTok using the hashtags #KASTCashback and/or #KASTReferrals during the Campaign Period.
8.2 Prizes
The following UGC Contest prizes are available each week during the Campaign Period:
- Weekly Best Post: USD 500 (one winner per week)
- Weekly Runners-Up: USD 100 each (up to five runners-up per week)
Total estimated UGC Contest prize pool for the Campaign Period: USD 4,000.
8.3 Selection
Winners will be selected by the Company based on creativity, authenticity, and reach. The Company's selection decisions are final and not subject to appeal.
8.4 Content Rights
By entering the UGC Contest, you grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute your submitted content for marketing and promotional purposes. You represent and warrant that all content you submit is original, does not infringe any third-party rights, and complies with these Terms.
9. Excluded Transactions and Merchant Category Codes (MCCs)
9.1 Excluded Transactions
Transactions classified under the Excluded Merchant Category Codes (MCCs) listed in this Section, as well as any other categories of transactions that the Company and/or its card-issuing partners may designate as excluded from time to time pursuant to network rules or internal policies, shall not count toward any spend milestone, Base Referral qualification, Campaign-Qualified Referral qualification, or any other reward eligibility under this Campaign.
9.2 Excluded Merchant Category Codes (Non-Exhaustive)
The following MCCs are excluded from qualifying spend:
- 4829 — Wire transfer / money orders
- 5947 — Gift, souvenir, novelty and stored-value products
- 6010 — Manual cash disbursements
- 6011 — ATM / automated cash disbursements
- 6012 — Financial institutions — merchandise and services
- 6050 — Quasi-cash — member financial institution
- 6051 — Quasi-cash / foreign exchange / money orders / cryptocurrency purchases
- 6529 — Remote stored-value load
- 6532 — Payment transaction — member financial institution
- 6538 — Money transfer — merchant
- 6540 — POI Funding Transactions (Non-MoneySend)
- 6555 — Mastercard-initiated rebate/rewards
- 6611 — Overpayments
- 6760 — Savings bonds
- 7995 — Gambling, betting, lotteries
- Any MCC that a card scheme or the Company designates from time to time as "High-Risk", "Gambling", or "Prohibited"
This list may be updated by the Company at any time without prior notice. The Company reserves the right to exclude additional MCCs or transaction types at its sole discretion.
10. Prohibited Conduct
In addition to the prohibited conduct set out in the General Referral Terms, you must not, in connection with the Campaign:
- Create fake or duplicate accounts to generate referrals or inflate Leaderboard rankings;
- Refer yourself or use accounts you control as referred users;
- Offer cash, cryptocurrency, or other inducements to referred users in exchange for sign-ups or spend activity, except through the referral rewards structure provided by the Platform;
- Manipulate or artificially inflate spend activity of referred users;
- Submit UGC Contest entries that contain misleading earnings claims, fabricated screenshots, or content that violates applicable advertising or consumer protection laws;
- Engage in spamming, unsolicited mass messaging, or any promotional activity that could harm the Company's brand or reputation; or
- Engage in any conduct that could constitute market manipulation or fraud.
10. Anti-Abuse and Clawback
The Company reserves the right to investigate any suspected abuse, fraud, or manipulation in connection with the Campaign. If the Company determines, in its sole discretion, that a Participant has engaged in prohibited conduct or otherwise violated these Terms, the Company may:
- Disqualify the Participant from the Campaign;
- Withhold, adjust, or reclaim any Referral Rewards, Milestone Bonuses, Leaderboard prizes, UGC Contest prizes, or Premium Tier Unlock granted;
- Suspend or terminate the Participant's KAST account; and
- Take any other action it deems appropriate, including reporting the conduct to relevant authorities.
11. Intellectual Property
All rights, titles, and interests in and to the Platform, including all trademarks, logos, content, and technology, remain the exclusive property of the Company. No rights or licenses are granted to Participants except as expressly set out in these Terms or the General Referral Terms.
Participants may use the Company's name, logo, and approved marketing materials solely for the purpose of promoting their referral activities in connection with the Campaign, provided such use complies with the Company's brand guidelines. The Company reserves the right to require removal of any materials it deems non-compliant.
12. Personal Information and Privacy
Personal Information collected in connection with the Campaign is processed in accordance with the Company's Privacy Policy. By participating, you consent to the collection, use, and disclosure of your Personal Information as described in the Privacy Policy.
All data regarding referred users belongs exclusively to the Company. Participants must not collect, store, or use any Personal Information of referred users except as expressly authorized by the Company.
13. Notifications and Communications
You agree to provide the Company with accurate and complete contact information. Service notifications from the Company may be sent by email, SMS, push notification, or through KAST's official community channels and constitute effective notice for the purposes of these Terms.
14. Representations and Warranties
By participating in the Campaign, you represent and warrant that:
- All information you provide to the Company is true, complete, and accurate;
- You have the legal capacity and authority to enter into these Terms;
- Your participation does not violate any applicable law or any agreement to which you are a party;
- You are not subject to any sanctions, export controls, or other restrictions that would prohibit participation or receipt of rewards; and
- You are not, and are not affiliated with, any person or entity identified on any sanctions list maintained by OFAC, the United Nations, the European Union, or any other relevant governmental authority.
You agree to promptly notify the Company if any of the above representations ceases to be accurate.
15. Relationship of the Parties
Nothing in these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between you and the Company. You are an independent participant and have no authority to bind or make commitments on behalf of the Company.
You are solely responsible for all costs and expenses you incur in connection with the Campaign and for complying with all applicable tax, regulatory, and reporting obligations.
16. Modifications
The Company reserves the right, at any time and at its sole discretion, to:
- Modify, update, or amend these Terms;
- Modify, update, suspend, or discontinue the Campaign or any component thereof;
- Adjust reward amounts, bonus structures, Leaderboard mechanics, prize pools, or eligibility criteria; and
- Extend or shorten the Campaign Period.
Where practicable, the Company will provide reasonable notice of material changes. Your continued participation following the effective date of any change constitutes acceptance of the revised Terms.
17. Disclaimer of Warranties
THE PLATFORM AND ALL SERVICES PROVIDED IN CONNECTION WITH THE CAMPAIGN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE PLATFORM WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE AT ALL TIMES.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE CAMPAIGN, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE COMPANY'S AGGREGATE LIABILITY TO YOU IN CONNECTION WITH THE CAMPAIGN SHALL NOT EXCEED THE TOTAL REWARDS PAID TO YOU DURING THE CAMPAIGN PERIOD, OR USD 1,000, WHICHEVER IS GREATER.
Some jurisdictions do not permit certain limitations of liability. In such jurisdictions, the above limitations apply to the fullest extent permitted by applicable law.
18.1 Force Majeure
The Company will not be liable for any failure or delay in performance of its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, governmental action, power or network failures, cyberattacks, or failures of third-party service providers.
19. Indemnification
You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your participation in the Campaign;
- Your breach of these Terms or any applicable law or regulation;
- Any content or materials you create or distribute in connection with the Campaign (including UGC Contest entries); or
- Any claim by a third party arising from your actions or omissions in connection with the Campaign.
20. Suspension and Termination
20.1 Withdrawal by Participant
You may withdraw from the Campaign at any time by ceasing all Campaign-related promotional activities. Withdrawal does not affect Referral Rewards already earned and verified prior to withdrawal.
20.2 Suspension or Termination by the Company
The Company may, at its sole discretion and without prior notice, suspend or terminate your participation in the Campaign, withhold or reclaim any unpaid rewards or prizes, and take any other action it deems appropriate if:
- You breach any provision of these Terms or the General Referral Terms;
- The Company identifies fraud, abuse, or irregularity in your activities or those of your referred users;
- It becomes unlawful for either party to continue performance under these Terms;
- You are, in the Company's reasonable opinion, no longer fit and proper to participate; or
- The Company decides to suspend or discontinue the Campaign.
20.3 Effect of Termination
Upon termination of your participation, you must immediately cease all Campaign-related promotional activities. In the event of termination for breach, fraud, or serious misconduct, you will not be entitled to any outstanding rewards, bonuses, or prizes.
The following provisions survive termination: Sections 2, 11, 12, 14, 15, 18, 19, and 22.
21. Records
The Company's records relating to the Platform and the Campaign shall be final, conclusive, and binding on Participants for all purposes. You agree that such records are admissible as evidence and waive any right to challenge their admissibility or authenticity solely on the basis that they were produced by a computer system or are in electronic form.
22. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be subject to and governed by the laws, jurisdiction, and dispute resolution mechanisms set out in the KAST Terms of Service. By participating, you expressly acknowledge that you are bound by the dispute resolution provisions of the KAST Terms of Service, including any limitations on liability, waivers of class action proceedings, and requirements for individual arbitration as specified therein.
23. General Provisions
23.1 Entire Agreement
These Terms, together with the General Referral Terms, the Terms and Conditions of Service, and the Privacy Policy, constitute the entire agreement between you and the Company with respect to the Campaign and supersede all prior agreements, representations, and understandings relating to the same subject matter.
23.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
23.3 Waiver
No failure or delay by the Company in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. Any waiver must be in writing.
23.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without the prior written consent of the Company. The Company may assign or transfer these Terms, in whole or in part, without restriction.
23.5 No Third-Party Beneficiaries
These Terms do not confer any rights or remedies on any third party, except where expressly stated otherwise.
23.6 Language
These Terms are made in the English language. In the event of any inconsistency between the English version and any translation, the English version shall prevail.
